IBC 2016 Under Scrutiny at NCLAT: Key Legal Issues in SIDBI vs Jiwrajka Brothers

Today, the Insolvency and Bankruptcy Code (IBC) 2016 faces critical examination at the National Company Law Appellate Tribunal (NCLAT).

The case of Small Industries Development Bank (SIDBI) vs Jiwrajka Brothers, represented by Advocate Dr. Ajay Kumar Pandey, a noted Supreme Court advocate, brings several pivotal questions to the forefront.

Key Legal Issues at Trial:

Adjudication at Initial Stage of Insolvency Against Personal Directors: Despite the Supreme Court's clear stance in Dilip Jiwrajka vs Union of India, where it was ruled that personal insolvency cannot be adjudicated at the initial stage, the National Company Law Tribunal (NCLT) Ahmedabad rejected the personal insolvency petitions against the Jiwrajka brothers on grounds including limitation and concealment of facts by the petitioner.

Today, NCLAT must decide whether the Debt Recovery Tribunal (DRT) under the SARFAESI Act can serve as the forum for personal insolvency.

Law of Limitation and Impact on Guarantors: The tribunal will also address whether creditors can initiate personal insolvency against guarantors after the principal borrower's debts have been settled, exploring the intersection of the IBC with the Contract Act and the Law of Limitation.

Background: Alok Industries, once under the control of the Jiwrajka brothers, was acquired by the Reliance Group through the insolvency process.

The company, notorious for a default exceeding ₹30,000 crores, also drew attention for its involvement in the Pandora Papers and a CBI probe into alleged bribery.

This hearing could set significant precedents in the application of the IBC, impacting future insolvency proceedings and creditor rights.
