अगर महिला शादी का झूठा वादा कर पुरुष को फँसा लेती है तो उस पर रेप का मुक़दमा नहीं चल सकता, इसलिए बलात्कार का क़ानून जेंडर नूट्रल होना चाहिए- हाईकोर्ट

एक महत्वपूर्ण विकास में, केरल उच्च न्यायालय ने मौखिक रूप से टिप्पणी की कि बलात्कार के अपराध को जेंडर नूट्रल बनाया जाना चाहिए।

न्यायमूर्ति ए मोहम्मद मुस्ताक की खंडपीठ ने अपने बच्चे की कस्टडी को लेकर तलाकशुदा जोड़े द्वारा दायर एक वैवाहिक मामले पर फैसला सुनाते हुए यह टिप्पणी की।

कोर्ट ने यह टिप्पणी तब की जब उसे बताया गया कि पति एक बार बलात्कार का आरोपी था।

पति के वकील ने अदालत को सूचित किया कि वह फिलहाल जमानत पर बाहर है और शादी के बहाने सेक्स का आरोप लगाते हुए मामला दर्ज किया गया था।

इस पर, अदालत ने कहा कि बलात्कार कानूनों को जेंडर नूट्रल होना चाहिए क्योंकि अगर कोई महिला शादी के झूठे वादे के तहत किसी पुरुष को बरगलाती है तो विचाराधीन महिला पर मामला दर्ज नहीं किया जा सकता है।

गौरतलब है कि न्यायमूर्ति मुस्ताक ने एक अन्य फैसले में भी अपनी राय व्यक्त की थी कि बलात्कार के अपराध से संबंधित कानून लिंग-तटस्थ नहीं हैं।

In a significant development, the High Court of Kerala orally remarked that the offence of rape should be made gender-neutral.

The Bench of Justice A Muhamed Mustaque made this observation while adjudicating a matrimonial case filed by a divorced couple over their child’s custody.

The Court made the remark when it was informed that the husband once was a rape accused.

The husband’s counsel informed the court that he is currently out on bail and the case was filed alleging sex under the pretext of marriage.

To this, the court replied rape laws should gender-neutral because if a woman tricks a man under the false promise of marriage then the woman in question cannot be booked.

Significantly, Justice Mustaque in another judgement had also expressed his opinion that laws related to the offence of rape are not gender-neutral.
